These Terms of Service ("Terms") are a binding agreement between you and Rock My Resume LLC, doing business as Rock My Websites ("Rock My Websites", "we", "us" or "our"). They apply when you request a free preview, book a call, purchase a plan or otherwise use our websites or services (together, the "Services"). Our Privacy Policy and Cancellation & Refund Policy are part of these Terms.
By checking out, paying for a plan or using the Services, you agree to these Terms. If you don't agree, please don't use the Services.
1. Who can use the Services
Our Services are offered to businesses. By using them, you confirm that you are at least 18 years old, that you're using the Services for a business purpose, and that you have authority to accept these Terms on behalf of the business you represent ("you" or "your" refers to that business).
2. What we provide
We design, build, host and maintain websites for small and local businesses on a monthly subscription. The features of each plan (Starter, Growth and Pro) are described on our Pricing page as of the date you sign up. If we change a plan's features, we'll give you at least 30 days' notice of any change that removes something you're paying for.
3. Free previews
A free preview is a sample homepage we design to show what we could do for your business. Previews are free and create no obligation for either of us. We may use publicly available information about your business (such as your existing website, Google Business Profile and published photos) to create it. Previews are shared only by private link, and we won't publish a preview as your live website unless you sign up. The design of a preview remains ours unless you purchase a plan.
4. Subscriptions, automatic renewal and billing
- Automatic renewal: your plan is a monthly subscription that renews automatically every month on the same day of the month you signed up, at the monthly price of your plan, until you cancel. You can cancel anytime as described in our Cancellation & Refund Policy.
- Authorization: by checking out, you authorize us and our payment processor, Stripe, to charge your payment method the monthly price of your plan on each renewal date, plus any extra services you approve, until you cancel. We don't see or store your full card number.
- Price: prices are in US dollars. There is no setup fee and no minimum term. The price shown at checkout is the total monthly price for your plan. If any sales tax applies to your purchase, it will be shown before you pay.
- Price changes: we'll email you at least 30 days before any price increase applies to your plan. If you don't want to continue at the new price, you can cancel before it takes effect.
- Receipts: Stripe emails a receipt for every payment. You can view invoices and update your payment method anytime in your customer portal.
- Failed payments: if a payment fails, we'll notify you and Stripe will retry the charge. If the balance is still unpaid 14 days after the due date, we may pause your website and Services until it's paid.
- Disputes: if you believe a charge is wrong, please contact us first at support@rockmywebsites.com so we can fix it quickly. Billing errors are refunded as described in our Cancellation & Refund Policy.
5. Changing plans
You can upgrade or downgrade anytime from your customer portal or by emailing us. The change takes effect at the start of your next billing period, and your price changes from that bill onward. Features that aren't included in your new plan end at that time.
6. Building and launching your website
- Your materials: you'll provide your logo, photos, business details and any other information we reasonably need. We write the website copy and build the pages.
- Revisions: before launch you get 1 round of changes on Starter, 2 on Growth and 3 on Pro. After launch, changes count toward your monthly updates.
- Approval: we launch your website after you approve it. Please review it carefully. You're responsible for making sure the facts about your business (such as prices, licenses, services, hours and any claims) are accurate.
- Timing: timelines we give (such as "live in 1–2 weeks") are estimates and depend on receiving your materials and approvals. If we're waiting on you for more than 30 days, we may launch with the content we have, with placeholders clearly marked, so your site isn't held up indefinitely.
7. Monthly updates
- A small update is a change that takes about 15 minutes or less, such as new hours, a price, a photo or a paragraph of text.
- Starter includes 2 small updates per month, Growth includes 5, and Pro includes unlimited small updates (reasonable use). Unused updates don't roll over.
- Extra small updates are $25 each. Larger work (such as a new page or a redesign) is quoted in writing before we start, and we only begin once you approve the quote.
- Fixing anything that doesn't work because of our work is always free.
8. Your content
You keep all ownership of the logos, photos, text, trademarks and other materials you provide ("Your Content"). You grant us a non-exclusive, royalty-free license to use, copy, edit and display Your Content only as needed to provide and promote your website and the Services. You confirm that you own Your Content or have permission to use it, and that it doesn't infringe anyone's rights or break any law. If we source stock images for you, we'll only use images licensed for that use.
9. Your domain
Your domain name is registered in your name and belongs to you. You pay your domain registrar directly and are responsible for keeping your domain renewed. You'll give us access to your domain's DNS settings so we can connect your website, and we'll walk you through it.
10. Ownership of the website
- We own the designs, code, templates and other materials we create or use to build your website (the "Website Materials"), excluding Your Content. While your subscription is active and paid, you have the right to use your website for your business.
- After 12 consecutive months of paid service, you may request a copy of your website files at no charge if you cancel, and we'll transfer them to you.
- If you cancel before 12 months of paid service, you may purchase your website files for a one-time buyout fee of $499, payable before transfer.
- When website files are transferred to you, you receive ownership of the custom design and content we created specifically for your website. Third-party software, services, fonts and stock images remain subject to their own licenses, and you may need your own accounts for them.
- We may reuse our general know-how, techniques and non-client-specific templates for other clients.
- Unless you tell us not to, we may show your website in our portfolio and marketing. You can opt out anytime by emailing us.
11. Google, social media and reviews
- We set up your website to be found on Google and connect it to your Google Business Profile. We don't guarantee any search ranking, traffic, leads, reviews or sales, because those depend on factors outside our control.
- On plans that include social posts or review replies, we prepare them for you. Where a platform requires it, you approve and publish them from your own account. You're responsible for content published from your accounts.
12. Third-party services
Your website and our Services rely on third parties such as Google, social media platforms, domain registrars, hosting providers and Stripe. Your use of those services is subject to their own terms. We're not responsible for their outages, policy changes, account suspensions or fees.
13. Accessibility and legal requirements
We design with common accessibility and mobile-friendly practices in mind. However, unless we agree otherwise in writing, we don't guarantee that your website meets any particular accessibility standard or law, and you're responsible for legal requirements specific to your business and industry (such as licensing information, required disclosures or your own privacy policy if you collect customer information).
14. What we don't do
We don't run paid ads, take professional photos or video, build online stores or custom software, or sell link-building packages.
15. Acceptable use
You agree not to use your website or the Services for anything illegal, fraudulent, misleading, harassing, hateful or infringing, to send spam, or to distribute malware. We may refuse to publish, or remove, content that we reasonably believe breaks this section.
16. Hosting, security and backups
We host your website with reputable providers, use HTTPS and keep regular backups. We work to keep your website online and secure, but we don't guarantee uninterrupted or error-free service, for example during provider outages or maintenance. Please keep your own copies of Your Content.
17. Cancellation and termination
- By you: you can cancel anytime, as described in our Cancellation & Refund Policy.
- By us: we may suspend or end the Services if you don't pay, materially breach these Terms or use the Services in a way that's illegal or harmful. Except where immediate action is needed to prevent harm or comply with law, we'll give you written notice and a reasonable chance to fix the problem first. If we end the Services without cause, we'll refund any prepaid amount for the unused part of your billing period.
- Sections that by their nature should continue after termination (including ownership, payment obligations, disclaimers, limitation of liability and indemnification) will survive.
18. Confidentiality
We'll keep non-public information you share with us about your business confidential and use it only to provide the Services, except where disclosure is required by law.
19. Disclaimer of warranties
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
20. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) NEITHER PARTY IS LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR BUSINESS OPPORTUNITIES; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits don't apply to liability that can't be limited under applicable law, such as liability for fraud or willful misconduct.
21. Indemnification
You agree to defend, indemnify and hold us harmless from claims, losses and reasonable legal fees arising from Your Content, the products or services your business offers, or your breach of these Terms or the law.
22. Events outside our control
Neither party is responsible for delays or failures caused by events beyond its reasonable control, such as natural disasters, internet or provider outages, or government action. This doesn't excuse payment obligations for Services already provided.
23. Disputes and governing law
If you have a concern, please email us first. We'll try to resolve it informally within 30 days. These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. Any dispute that isn't resolved informally will be brought in the state or federal courts located in Massachusetts, and both parties consent to their jurisdiction. Either party may bring a qualifying claim in small claims court.
24. General
- Electronic communications: you agree that we may communicate with you by email, and that notices sent to the email address on your account satisfy any requirement that notices be in writing. Notices to us should be sent to info@rockmywebsites.com.
- Relationship: we're an independent contractor. Nothing in these Terms creates a partnership, joint venture or employment relationship.
- Assignment: you may not transfer these Terms without our written consent. We may transfer them in connection with a merger, sale or reorganization of our business, and we'll notify you if we do.
- Entire agreement: these Terms, our Pricing page as of your sign-up date, and the policies linked above are the entire agreement between us about the Services, and replace any prior discussions. Any written quote you approve for additional work is also part of this agreement.
- Severability and waiver: if any part of these Terms is found unenforceable, the rest stays in effect. Not enforcing a right isn't a waiver of it.
- Changes: we may update these Terms. For material changes, we'll email current clients at least 30 days before they take effect. If you continue using the Services after that, the updated Terms apply. If you don't agree, you can cancel before they take effect.
